The Long Service Leave Regulations 2002 have now expired and have been replaced by the Long Service Leave Regulations 2017, effective from 1 September 2017.
The Long Service Leave Regulations are made under the Long Service Leave Act 1987 and provide details or records to be kept by employers and 'notice to worker' requirements.
SafeWork SA undertook a period of public consultation seeking stakeholder comments on the 2002 Regulations to address technical issues and improve usability of the Regulations.
Comments received through the consultation process were taken into consideration in the development of the new Regulations.
The 2017 Regulations include minor changes to address technical inconsistencies and modernise the layout.
We have developed a range of tools to assist employers and workers to better understand and comply with their long service leave obligations.
These tools include guidance material on South Australia's long service leave laws, as well as an online calculator to determine a worker's long service leave entitlement and online forms to assist employers to comply with their record keeping requirements.
