CONTENT: The introduction of new WHS laws has started across Australia, and among the changes is a greater emphasis on the hierarchy of controls.
‘Falls from height’ is already one of the highest risks in the construction industry. Under the new WHS laws it is regarded as high risk work, with increased fines and personal liability for Officers.
The new Regulations introduce a five level hierarchy which can be used in a practical approach to the application of controls to height safety from design and construction through to use and maintenance.
This presentation will look at the practical application of these issues.

DUTIES OF PCBUs AND OFFICERS – PRACTICAL GUIDANCE FOR EMPLOYERS

CONTENT: Under the proposed new WHS legislation, the term ‘employer’ will be replaced by ‘person conducting a business or undertaking’ (PCBU) either alone or with others.
To meet the definition, the business or undertaking can operate for profit or not-for-profit. The definition of a PCBU focuses on the work arrangements and the relationships required to carry out the work. In addition to employer, a PCBU can also be a corporation, an association, a partnership or a sole trader.
An ‘officer’ is a person who makes decisions, or participates in making decisions that affect the whole, or a substantial part, of a business or undertaking and has the capacity to significantly affect its financial standing. If a person is responsible only for implementing those decisions, they are not considered an officer.
This session will assist you to understand the duties of PCBUs and officers under the new legislation.
