Awards (Wages & Conditions)

New national IR laws will alter coverage of South Australian industrial awards

As of 1 January 2010, South Australian private sector employers and employees operate under new national industrial relations laws. This means that the coverage of South Australian industrial awards has changed.

The Commonwealth Fair Work Act 2009 now covers the whole of the private sector, including the non-government community services sector, private schools and universities.

Please note: as of 1 January 2010, the industrial awards provided at the links below , apply only to employers and employees in the South Australian public sector, local government and prescribed Government Business Enterprises.

The new national industrial laws provide for former state awards and agreements to be transferred to the Commonwealth and operate there for a time. If you are in the private sector the award links below may provide useful reference points. However, the award may have a modified form under the Commonwealth Fair Work Act 2009.

State Awards

Awards covering conditions and entitlements can be made under state or federal legislation. Only Awards made under the South Australian Fair Work Act 1994 are available from this site.

SafeWork SA provides free rate sheet updates for some state Awards and they are intended to provide a summary of the major payments under the relevant award. Please note however that this service is not intended to be a substitute for the Award or formal advice of changes. Employers should take the necessary steps to ensure that they are independently aware of changes to the wages and other conditions. Further, employers must ensure that an up-to-date copy of the relevant Award is accessible in the workplace.

Awards with a rate sheet available are identified with an * in the list below.

To register for our rate sheet subscription service: select the appropriate award from the list below, click the "Notify Me ..." link and complete your details. Repeat this for each of the awards that you require.

Increase in Award Rates of Pay and the Minimum Wage

On 21 August 2009, the Industrial Relations Commission of SA handed down its 2009 General Review of Award Wages and Minimum Standard for Remuneration Decision. The Commission has determined that Adult award rates of pay will be increased by $14.00 per week, and the new State Minimum Award Wage will be $560.65 per week. All awards and the minimum wage will be increased from a common operative date of the first pay period to commence on or after 1 October 2009.

Wage Rate Sheets published by SafeWork SA will be made available as soon as the Registrar has made the required variations to the relevant awards.

The Statement, Decision and Orders are available under "Latest News" on the Commission's website.
